Clemmons Family Martial Arts Terms of Service and Liability Waiver

 

In order to train in Taekwondo, Hapkido, Arnis or other martial art at Clemmons Family Martial Arts, all students or parents or guardians or caregivers of a student agree to these Terms of Service and Liability Waiver.

I fully understand that all physical activities inherently pose some degree of risk. I further understand that;

 

A. There are risks and dangers associated with Martial Arts training including but not limited to bodily injury, partial or total disability, paralysis and possibly death. There are some unavoidable circumstances where medical/health conditions may require special caution on my part to minimize danger to myself or others, and I acknowledge that it is my responsibility to act accordingly;

 

B. it is possible that some students could possibly be infected with potentially communicable diseases, which can be transmitted by exchanges of blood, sweat, or skin contact and that I may be training with such individuals without knowledge of such. I have read and will follow explicitly the Clemmons Family Martial Arts Safety Policy, a copy of which is provided with this document;

 

C. social, emotional, astrological or psychological damages, economic losses or other risks may result from training.

 

I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, OR DEATH SUSTAINED WHILE PARTICIPATING IN OR OBSERVING, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES DESCRIBED IN THIS AGREEMENT.

 

I accept and assume all such risk and responsibility however caused, or alleged to be caused, including injuries caused in whole or in part by the negligence of Clemmons Family Martial Arts, its representatives, agents, employees, volunteers, instructors, other participants, owners, lessors, and lessees of the premises including their officers, directors, agents and employees.

 

I release the agents, volunteers, associates, instructors, employees, lessors, and lessees and any/all individuals associated with Clemmons Family Martial Arts from any and all liability, claims, demands or actions whatsoever arising out of the damage, loss or injury to me while utilizing the Clemmons Family Martial Arts facilities or while participating in Taekwondo, Hapkido, Brazilian Jiu-Jitsu or other martial art training or any other activities contemplated by this agreement, whether such loss, damage, or injury results from negligence or otherwise.

 

This document covers each and every time that I train or otherwise participate in any activity, listed or unlisted, at Clemmons Family Martial Arts or at any other location sponsored by Clemmons Family Martial Arts, its agents, employees or instructors. This liability waiver is in effect from the moment I arrive until the moment I leave Clemmons Family Martial Arts, even if I am not training when an alleged incident occurs.

 

I agree to INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES from all claims, judgments, and costs including attorney’s fees incurred in connection with any action brought as a result of my participation in any activity in association with Clemmons Family Martial Arts and will not sue or make legal claim against the released parties as the result of my participation at Clemmons Family Martial Arts or at any other location where Taekwondo, Hapkido, Brazilian Jiu-Jitsu or other martial arts training takes place.

 

I understand that I am forfeiting my right to sue any and all parties relating to my martial arts training under any and all circumstances.

 

I have been advised not to attempt any training activity of which I do not believe myself to be fully capable. I realize that the study of martial arts requires proper physical conditioning, which I may or may not possess. I understand that it is recommended that I attain a formal physical evaluation by a physician prior to participating at Clemmons Family Martial Arts.

 

I agree to abide by the training rules of Clemmons Family Martial Arts and to follow all instructions given by instructors during the course of my training. It is the sole decision of the instructors whether or not I may continue training.

 

Photo/Video Release

On occasion Clemmons Family Martial Arts may use literature, photos, and video to promote our school to the general public. I understand that I will not receive compensation in any form from the use of my photograph or my photographic likeness and recorded voice.

 

I hereby consent to the use of my name, photograph, photographic likeness, recorded voice and/or image in the video that may appear in any publications, promotional posters, flyers, brochures, printed and electronic ads or electronic media, in addition to the Clemmons Family Martial Arts website.

Payments For Classes

Tuition may be paid by bank draft or credit card draft only.  All Tuition bank drafts or credit card drafts will be collected through Member Solutions, a Martial Arts billing company. Student memberships are ongoing and are cancelable with 30 days written notice. You can complete a Cancellation Request HERE. You can also mail written notice to Clemmons Family Martial Arts 6311 C Stadium Drive Clemmons, NC 27012.  We cannot cancel membership by phone. Please do not leave telephone messages regarding membership status changes.

Suspending classes for more than 30 days may result in the loss of the slot in your preferred classes and you will be subject to current fees rather than the fees you were paying.   If you have been with us for a long time and have a low rate then don't risk it by stopping you billing and restarting later.  When you restart it will be at the current unlimited rate, not the rate you were paying.

Member Solutions charges a Service Fee of $25.00 on any returned financial item presented for collection and returned for any reason.

Member Solutions charges a $7.50 late fee for all payments paid past their due date.

The school reserves the right to terminate a student’s membership if it deems necessary.

​

Please remember that your monthly tuition is for membership in your selected program and is due regardless of your personal attendance habits.

Refund Policy

No refunds. You may cancel your subscription at any time with 30 days written notice in accordance with our Cancellation Policy (describe above), but there will not be a refund unless legally required. You should maintain vigilance concerning your financial affairs by checking your bank statement each month for any errors.

 

I affirm I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY; I INTEND IT TO BE A COMPLETE RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE invalid, illegal or unenforceable to any extent and for any reason by any Court of competent jurisdiction, the remainder of this agreement shall not be affected thereby and shall be enforceable to the full extent permitted by law.

 

I agree with these terms and conditions and liability waiver on behalf of myself, my minor children or guardian, my heirs, successors, and executors.  By checking the box for “I Agree to Liability Waiver” on the Sign Up form I am asserting that I am at least 18 years of age and a legal adult.
